Welcome to Jay Kelly Designs LLC (“JKD,” “we,” “us,” “our”). These Terms & Conditions (“Terms”) govern your access to and use of our website, platform, and services. By using our environment, purchasing a plan, or opting in to SMS, you agree to these Terms.
If you have a separate written agreement (Proposal or Statement of Work), it may supplement or override specific sections of these Terms where there is a direct conflict.

The System Subscription
JKD offers a $296/month subscription plan that includes:
- A fully built website framework
- Access to the Jay Kelly Designs platform (web and mobile app)
- Business phone number for integrated communication
- CRM, Automations, and Remarketing tools
- Customer review and reputation management tools
02 // Billing & Auto-Renewal
Advance Payment Protocol
Subscription fees are billed in advance and auto-renew each billing cycle until canceled. By subscribing, you authorize JKD to charge your saved payment method for recurring fees and any applicable usage-based charges.
Payment Failures
If a payment fails, JKD reserves the right to suspend platform access and related services immediately until the account is brought current.

In addition to your subscription fee, clients incur charges based on active usage of telephony and data services:
04 // Refund Policy (Strict No-Refunds)
ALL PAYMENTS MADE TO JAY KELLY DESIGNS LLC ARE FINAL AND NON-REFUNDABLE. By signing up, you acknowledge that our products are custom-built, immediately initiated, and non-reversible once delivery begins.
05 // Cancellations
You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. No future charges will be made beyond that point, and no refunds are provided for unused time or prepaid terms.
06 // SMS Messaging (A2P 10DLC)
Disclosure & Consent
By opting in, you agree to receive text messages from JKD related to service notifications, reminders, marketing, and account updates. Consent is collected through website forms, checkout, or verbal agreement and is not a condition of purchase.

No Guaranteed Results
We provide the tools and frameworks designed to improve lead capture. Results depend on factors outside JKD’s control. We do not guarantee specific financial outcomes, lead volumes, or conversion rates.
Limitation of Liability
JKD’s total liability for any claim related to the services will not exceed the amount you paid to JKD in the 30 days prior to the claim event.

JKD may update these Terms at any time. Continued use of our services after changes are posted constitutes your acceptance of the updated Protocol.
